Burgon & Ball settles with Gardman following infringement lawsuit

Following a long-running legal dispute between Burgon & Ball and Gardman concerning infringements on Burgon & Ball's products, a settlement has been reached.
The action related to Burgon & Ball's Home Allotment range of products, in particular its Potato Planter, Vegetable Planter and associated planting bags. According to Anti Copying in Design (ACID) IP lawyer Kelly Hudson, the garden supplier was "the victim of several infringements" when she met representatives at the 2010 Glee show.
"Subsequently," she added, "they decided to adopt a robust IP strategy and campaign to stamp out rights abuse of their unique designs. This has involved a financial legal commitment but the message is now crystal clear and appears to have resonated within the sector with no infringements discovered at Glee 2012 and no further infringements since then."
ACID's ceo Dids Macdonald added: "The penny is finally starting to drop that design-led companies who invest in innovation through design excellence that they will not tolerate free riding on the back of their creativity."
The conditions of the settlement remain confidential.
